2 Role as Data Fiduciary
Under Section 2(i) of the DPDP Act, 2023, "Where There Is a Will" operates as a responsible Data Fiduciary by storing and utilising the digital personal data solely for the lawful purpose of generating the draft of your Last Will and Testament or other related documents attempting to be in accordance with relevant provisions of the laws in force.

We collect only the minimum personal data necessary to create a draft Will and related documents:
Testator Identity
Full name, address, age, date of birth, father's/spouse's name
Official Identifiers
ID number, PAN, or Aadhaar references (if voluntarily provided)
Asset Details
Property descriptions, survey numbers, vehicle registrations, financial accounts
Entity Information
Names, addresses, and relationships of heirs, executors, and guardians
Communication Data
Email address and phone number for service delivery and support
Payment Information
Transaction details processed through Razorpay (we do not store card details)
5 Payments, Fees & Billing
All fees are quoted in INR and are exclusive of all taxes, duties, and levies. Payment obligations are non-cancellable, and fees paid are non-refundable.
Services are billed on a one-time basis unless a different term is specified in your service agreement.
6 Suspension & Termination
We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
7 Limitation of Liability
In no event shall "Where There Is a Will", nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
Disclaimers & Warranties
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
8 Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of courts in Kerala, India.
9 System Disclaimer
Where There Is a Will offers well-structured will templates to support the testator's estate planning process and the generation of a draft will. While crafted with care, the templates are to be used at the sole discretion of the testator and with the exercise of due caution. All data that is bound to the templates are based on entries made by the testator. Any liability and all consequences arising from the use of the template shall rest solely with the testator.
